Aadhaar not mandatory: You may or may not share your details

Date : 11/09/2017

There is no law of the country that mandates Aadhaar as a proof of identity for any purpose, except for benefits of PDS Scheme; LPG Distribution Scheme; Mahatma Gandhi National Rural Employement Guarantee Scheme (MGNREGS); National Social Assistance Programme (Old Age Pensions, Widow Pensions, Disability Pensions); Prime Minister’s Jan Dhan Yojana (PMJDY); Employees’ Providend Fund Organisation (EPFO) Prime Minister’s Jan Dhan Yojana.

However, the government has mandated possession of Aadhaar for many purposes, including academic purposes.

The Union government has already made Aadhaar mandatory for CAT, UGC-NET, NEET and JEE-Main. Not allowing registration based on any other identification proof, issued by the Government of India, is in direct violation of a series of Supreme Court orders and Aadhaar Act, 2016, that emphasis that Aadhaar is purely voluntary and not mandatory, except certain schemes.

On this submission, Delhi High Court allowed a candidate for UGC-NET (November) 2017 to register online for the examination based on the identity proofs other than Aadhaar.
