PIL for the strict implementation of the Street Vendors Act, 2014 to prevent damage of the livelihood of hawkers

The petitioner’s organization was established to extensively work for the rights of vendors. Through the PIL filed by him, he seeks for the proper direction and command upon the respondent authorities, for the strict implementation of the Street Vendors Act, 2014 in true sense so as to prevent further damage of the livelihood of the vendors as the hawkers and the street vendors belong to the economically as well as socially weaker section of the society

The Public Interest Litigation (PIL) is substantiated by fact finding study stating that in Jharkhand near about 30 thousand families are dependent on this profession and they are carrying on business by way of hawking and selling a variety of items without causing inconvenience to the general public and such hawking is their only source of livelihood as well as their respective family members.

The Anti Encroachment Drive is still continuing demolition and seizing goods, which is in violation of the provisions of the Street Vending Act 2014 as well as the direction of Hon’ble Supreme Court. Through the PIL, it was prayed that the Street Vendor’s Act 2014 should be implemented strictly and to direct the respondent authorities to not evict the vendors and to let them carry on their respective business.

Though notices were issued to the respective respondents, the counter affidavit is still not filed. The case was fixed for 3rd July 2017.
