Petition against paramilitary forces occupying government school premises in Jharkhand

School buildings namely Nav Prathmaik Vidyalay, Chirudih and Karanpura College, Barkagaon Block; Dadi Kalan Panchayat Bhawan were being used by the Central Reserve Police Force/ Para Military Force which was hampering the classes and activities of the school. Two public interest litigations were already disposed off by the hon’ble High Court of Jharkhand.

Through the PIL, the petitioners have prayed for direction to the respondents to immediately vacate the school premises since they have failed to implement the provisions of Right to Education and also amounts to gross violation of provisions enshrined under the United Nations Convention on the Rights of a Child which has been ratified.

In the counter affidavit filed by the State Authority, it is asserted that the Karnapura College, Barkagaon Block; and Dadi Kalan Panchayat Bhawan have already been vacated by the forces. As far as Nav Prathmik Vidyalay, Chirudih is concerned there is only 22 are mentioned in the admission register of the school and the school falls under the mining area. Therefore, the concerned state authorities have recommended for shifting/merging the school with any other nearby school as per law.

The General Manager of National Thermal Power Corporation(NTPC) stated that transportation facility will be done by them for the school going children. The Circle Officer, Barkagaon has recommended that the school can be transferred, if transportation facility is provided by the NTPC. The Central Government has not filed any reply yet. However, the case is likely to be listed soon.
